Comprehensive Privacy Notice for COSMOS® Mobile Application Customers

Intersphere S.A. de C.V.in its capacity as Responsible for the processing of personal data of its Customers through COSMOS ® Mobile Application offers you this Privacy Notice, which has been prepared in accordance with the Federal Law for the Protection of Personal Data in Possession of Individuals and its secondary regulations.

This Privacy Notice in its integral version is addressed to our Clients through the COSMOS ® Mobile Application.

Personal data

List of personal data subject to processing

We inform you that Intersphere S.A. de C.V. processes several personal data, being the following:

  • Full name
  • E-mail address
  • Cell phone
  • Location
  • Access to the camera
  • Access to the photo gallery
  • Access to folders

Sensitive Personal Data

We inform you that we do NOT collect or process sensitive personal data of our Clients.
In the event that a change is required, we will notify you of such change in our Privacy Notice.

How do we collect your personal information?

We obtain the personal data we collect in the following ways:

i. Directly:
a. Through our registration forms
b. Through our COSMOS ® web platform.

Purposes of the processing of personal data

The purposes are those that motivate the processing of your personal data, for your understanding and by provision of law are classified into primary and secondary, the primary being those that are necessary for the development of a legal obligation or the main reason for which there is a relationship between the Holder (you) and the Responsible (us); the secondary purpose is one that is not necessary for the development of a legal relationship, so you can tell us that you do not authorize the processing of your personal data in any or all of the above.

  2. Work order assignment and dispatch
  3. Generate and collect evidence of work order fulfillment
  4. Work order report generation
Secondary purposes
  • Sending satisfaction surveys
  • Generate analytics on consumer behavior to improve consumer experience
Mechanism for expressing non-acceptance of secondary purposes

In the event that we collect your personal data via a form, you must make use of your Right of Opposition established in the section “Rights of Access, Rectification, Cancellation and Opposition (ARCO)”.

Transfers of personal data

Intersphere may transfer personal data to Mexican or foreign third parties.

  • In the cases established in article 37 of the Federal Law for the Protection of Personal Data in Possession of Individuals, for which your consent is not required.
  • To third parties that are business partners of Intersphere S.A. de C.V. in order to fulfill the primary and secondary purposes mentioned above.

Rights of Access, Rectification, Cancellation and Opposition (ARCO)

What are ARCO Rights?

ARCO Rights are the legal mechanism that allow you to exercise your Rights of Access, Rectification, Cancellation and Opposition, which consist of:

  • Access to personal data, exclusively yours, unless you are the legal representative or guardian of another owner, which are under our treatment.
  • Request that we make corrections or updates to your personal data
  • Request that we delete your personal data, where this is legally permissible.
  • Oppose the fulfillment of the primary purposes set forth in this Privacy Notice – in which case the services we offer will no longer be provided.
  • To request your opposition to the execution of the secondary purposes indicated.
  • Request that your personal data not be transferred to third parties.
  • Limit the use or revoke consent to the processing of your personal data.
Means to exercise ARCO Rights

In order for you to exercise any of your ARCO rights, you must do so in person by following the procedure indicated in the “Procedure to Exercise ARCO Rights” section of this Notice.

Procedure to exercise ARCO Rights

The owner of the personal data must present at Blvd. Anillo Periférico Adolfo López Mateos 4293, Piso 3, Interior 300, Colonia Jardines en la Montaña, C.P. 14210, Alcaldía de Tlalpan, Mexico City, from Monday to Friday from 9:00 a.m. to 1:00 p.m., a free writing that includes at least the following information:

  • Full name of the holder of the personal data
  • Ways to contact you and let you know the answer, either any of the following:
    • Address to receive SEPOMEX’s courier services
    • Home phone number
    • Cell phone number
    • E-mail address
  • Clear and precise mention of the right you are seeking to exercise, one at a time.
  • Valid official identification, which must be presented in original and copy for comparison.
  • In case you are not the owner of the personal data, you must attach the document that accredits you as the legal representative.
  • In case of requesting changes derived from corrections or updates, the legal document that accredits this fact must be presented.
  • Additional and precise information to facilitate the search for the requested data, indicating – as far as possible – the data you have provided us with and/or the period in which they were provided.
  • Autographic signature, which must coincide with the official identification presented to carry out the procedure.

Within 5 business days of receiving your request, if there is a question or if we require more information about your request, we will contact you to inform you of the situation and obtain more information from you regarding the request. The response to our request must be made within 10 business days.

Within 20 business days after receiving your request, or after having answered the clarifications requested by us, we will contact you in order to communicate the response to your request, this response will be delivered personally at our address, after accreditation of the owner or his representative.

Consent

We inform you that we do NOT collect and process sensitive personal data, however, we do perform the transfer of data to fulfill the purposes described above, so your acceptance is necessary.

Mechanism to revoke the consent granted for the Processing of your Personal Data

In the event that you wish to revoke your consent to the processing of your personal data, you must follow the same procedure established in the section “Rights of Access, Rectification, Cancellation and Opposition (ARCO)”.

Your request will be subject to review in our Privacy Area; in the event that it does not comply with a legal exception or there is no legal provision that subjects us to process your personal data, your request will be accepted and you will be notified of the decision within 10 business days.

Competent Authority

After having exercised your Rights of Access, Rectification, Cancellation or Opposition; Have limited the use or disclosure of your personal data, or have revoked your consent of your personal data, if you consider that we have made any omission or any action in violation of the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, we inform you that in accordance with the Federal Law on Protection of Personal Data Held by Private Parties, the competent Mexican authority before which you must file your complaint or disagreement is the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI).

Updates

This Privacy Notice will be updated in the future due to modifications to the legal framework regarding the protection of personal data, changes in the business model, new personal data collected and/or changes in the purposes.

The updates and modifications made to this Privacy Notice will be made known to you through a communication via e-mail that you have provided as a means of contact and by means of a publication in: https://intersphere.io.
